NextPitch Analytics is operated by NextPitch Analytics, Inc., a Delaware corporation incorporated on October 7, 2025, with principal offices at 19132 Loree Avenue, Cupertino, CA 95014. This Privacy Policy explains how we collect, use, protect, and share your information when you use our baseball and softball pitching analytics application.

We do NOT directly collect or store credit card information - all payment processing is handled securely by Apple App Store, Google Play Store, or Stripe
Data About Players Who Aren't NextPitch Users
When a coach or player tracks a game or scrimmage against another team, they enter information about the opposing players too, names, jersey numbers, and pitch-by-pitch batting data. Those players have not created a NextPitch account and have not agreed to this Privacy Policy.
This data is entered and controlled by the coach or player doing the tracking, not by us. We store it the same way we store any other performance data: privately, tied to the tracking team's account, never sold, and never shared for marketing.
The coach or player entering this data is responsible for having the right to track it, including when the player being tracked is a minor. We do not independently verify the age or identity of any player entered this way. That responsibility sits with the person doing the tracking, the same way it would if they kept their own scouting notes on paper.
If you are an opposing player, a parent or guardian of one, or a coach for an opposing team, and you want data about that player corrected or removed, contact the coach or team that tracked it directly, or contact us at analyticsnextpitch@gmail.com and we will work with the tracking team to resolve it.

NextPitch Analytics is intended for users aged 18 and older. We do not knowingly collect personal information from anyone under 18 years of age.
If you are under 18 years old, you may not create a new account or use our services.
If we discover that a new user is under 18, we will immediately terminate their account and delete all associated personal information from our systems.
If you are a parent or guardian and believe your child has created an account, please contact us immediately at analyticsnextpitch@gmail.com and we will promptly delete the account and all related data.
This age requirement applies to NextPitch account holders. It does not, and cannot, verify the age of opposing players entered by a coach or player while tracking a game, see "Data About Players Who Aren't NextPitch Users" above for how that data is handled.

California residents have comprehensive privacy rights under CCPA as amended by CPRA:

Exercising Your Rights: Submit requests via analyticsnextpitch@gmail.com with proper verification. We respond to verified requests within 45 days (extendable to 90 days). No charge for up to two requests per 12-month period. We may deny requests that are excessive, repetitive, or unfounded.

Anonymized usage analytics (no personal identifiers) retained indefinitely for service improvement
Data subject to legal holds or law enforcement requests
Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes in our practices or applicable laws. Material changes will be posted in the app with 30 days' notice.
Continued use of the service after changes take effect constitutes acceptance of the updated policy. The "Last updated" date at the top indicates when this Privacy Policy was last revised.

1. Acceptance of Terms
By accessing and using NextPitch Analytics ("the App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.

3. Description of Service
NextPitch Analytics is a baseball and softball pitching analytics application that allows users to track, analyze, and improve their pitching performance. The service includes pitch tracking, statistical analysis, team management, and performance insights for training purposes.
4. Unofficial Statistics Disclaimer
IMPORTANT: NextPitch Analytics is designed for training and improvement purposes only. The statistics, metrics, and data provided by this application are NOT official statistics and should NOT be used for official record-keeping, league statistics, or any formal baseball or softball documentation.
This app is intended solely for:
Personal pitching development and training
Performance analysis and improvement
Team practice and development
Educational and coaching purposes
For official statistics and record-keeping, please consult your league's official scorekeepers and statisticians.
5. User Accounts and Responsibilities
Account Creation and Verification:
You must be at least 18 years old to create an account
You must provide accurate, complete, and current information
You are solely responsible for maintaining account security and confidentiality
One account per user is permitted - shared accounts are prohibited
You must promptly update account information when changes occur
False information may result in immediate account termination
This eligibility requirement applies to account holders. It does not extend to, and cannot verify the age of, opposing players entered by a coach or player while tracking a game, see "Data About Other Players" below.
Prohibited Uses and Activities: You agree NOT to:
Use the service for any unlawful, harmful, or fraudulent purposes
Attempt to hack, reverse engineer, decompile, or extract source code
Interfere with or disrupt the service or servers/networks connected to the service
Upload malicious code, viruses, or harmful data
Impersonate others or provide false identity information
Share, sell, or transfer your account to other users
Collect user information without explicit consent
Use automated systems (bots, scrapers) to access the service
Circumvent security measures or access restrictions
Engage in any activity that could damage our reputation or business
Compliance Requirements:
You must comply with all applicable local, state, and federal laws
You are responsible for all activity occurring under your account
You must immediately notify us of any unauthorized account access
You agree to cooperate with any security investigations
6. Data Ownership and Usage
You retain ownership of your pitching data and statistics
We store your data securely and use it only to provide our services
You can export or delete your data at any time
We may use aggregated, anonymized data for service improvements
Data About Other Players:
Tracking a game or scrimmage means entering data about opposing players who are not NextPitch users, names, jersey numbers, and performance data. You are responsible for having the right to enter and track that data, including when the player is a minor, and for its accuracy. We do not independently verify the age or identity of any player entered this way, and we are not responsible for verifying it.
7. Subscription Terms
Subscription Plans:
We offer two subscription tiers, each available on a monthly or annual billing cycle:
Player: individual pitcher analytics
Team: full access, entire staff
The price for each tier and billing cycle is shown at the time of purchase in the App Store, Google Play Store, or NextPitch web portal, and may vary by region or promotion.
Players who are on a paid Team subscriber's roster receive free access to the app without needing their own subscription.
Auto-Renewal:
Your subscription automatically renews at the price shown at the time of purchase for your selected plan and billing cycle, unless cancelled.
Your payment method will be charged within 24 hours prior to the end of the current period. Cancel at least 24 hours before the period ends to avoid the next charge.
To manage or cancel: Open iPhone Settings → [Your Name] → Subscriptions → NextPitch Analytics → Cancel Subscription.
8. Billing and Payment
Payment is processed through the Apple App Store, Google Play Store, or Stripe (via the NextPitch web portal). Subscriptions are billed monthly or annually based on your selection, at the price shown at the time of purchase, in USD and subject to applicable taxes.
Restore Purchases: Your subscription is linked to your NextPitch Analytics account (email/password). When you sign in on a new device with your account credentials, your subscription status will be automatically restored. You will not be charged again for accessing your existing subscription on multiple devices.
Upgrades: When upgrading to a higher tier, you receive credit for the unused portion of your current subscription, and the new subscription begins immediately with prorated billing.
Downgrades: When downgrading, you retain access to your current tier until the end of your billing period. The downgrade takes effect at your next renewal date.
Failed Payments: If payment fails, access to subscription features is immediately revoked. Your data remains saved, but you cannot access it until payment is successful.
9. Cancellations and Refunds

Tap "Subscriptions"
Select "NextPitch Analytics"
Tap "Cancel Subscription"
For Stripe Subscriptions:

Cancellation takes effect at the end of your current billing period. You will retain full access until that date.
Refund Policy: Subscription fees are generally non-refundable. For Apple purchases, refund requests are subject to Apple's App Store refund policy and are handled directly by Apple. You may request a refund through Apple within certain time windows as determined by Apple's policies. For Stripe purchases, refund requests may be submitted to analyticsnextpitch@gmail.com and will be evaluated on a case-by-case basis.
NextPitch Analytics does not provide additional refunds or credits for partial subscription periods, unused features, or if you cancel mid-cycle beyond what Apple or Stripe may approve.
10. Subscription Features
The Team tier provides full access for your entire staff. The Player tier provides individual pitcher analytics. If your subscription expires, access to paid features is restricted until you renew.
Team Member Access: Players who are invited to join a Team subscriber's roster receive free access to the app, covered by that subscription. If the subscription expires or is cancelled, team members will lose free access and must subscribe to their own Player plan to continue using the app.
11. Price Changes
We reserve the right to modify subscription pricing. Existing subscribers will be notified at least 30 days in advance. Pricing changes take effect at your next renewal after the notice period.
12. Service Availability
We strive for maximum uptime but cannot guarantee 100% availability
Maintenance periods may temporarily interrupt service
We reserve the right to modify or discontinue features
Users will be notified of significant changes when possible
13. Force Majeure
We are not liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
During such events, our obligations under these Terms will be suspended for the duration of the force majeure event. We will make reasonable efforts to notify users of such events and resume normal service as quickly as possible once the force majeure event has ended.
14. Intellectual Property
NextPitch Analytics app and its features are our intellectual property
You may not copy, distribute, or create derivative works
User-generated content remains owned by the user
We respect the intellectual property rights of others
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
NextPitch Analytics is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We expressly disclaim liability for:
Any data loss, corruption, or unauthorized access (despite our security measures)
Service interruptions, downtime, or technical failures
Athletic performance outcomes or training decisions based on app analytics
Any injuries occurring during baseball activities while using our app
Third-party actions or content accessed through our service
Errors, omissions, or inaccuracies in analytics or data
Limitation of Damages: In no event shall NextPitch Analytics, Inc., its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, regardless of whether we have been advised of the possibility of such damages.
Damage Cap: Our total liability to you for all claims arising from or related to the service shall not exceed the amount you paid us for the service in the twelve (12) months preceding the claim, or $100, whichever is greater.
Essential Service Clauses: Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
16. Termination
You may delete your account at any time
We may suspend accounts for terms violations
Upon termination, your subscription ends immediately without refund
Your data will be deleted as requested
Some provisions of these terms survive termination

NextPitch Analytics is for training and educational purposes
We do not guarantee specific performance improvements
Consult qualified coaches for professional training advice
Use of the app does not guarantee athletic success
18. Governing Law and Dispute Resolution
These terms are governed by Delaware state law and federal US law, without regard to conflict of law principles.
BINDING ARBITRATION: Any dispute arising from these Terms or your use of the service shall be resolved by binding arbitration under the rules of the American Arbitration Association, rather than in court. Arbitration will be conducted in New Castle County, Delaware, or remotely via videoconference.
CLASS ACTION WAIVER: You agree to bring claims only in your individual capacity and not as part of any class or representative action. Neither you nor we may participate in a class-wide arbitration or lawsuit.
SMALL CLAIMS EXCEPTION: You may bring claims in small claims court if they qualify and remain in such court.
OPT-OUT: You may opt out of arbitration by emailing us at analyticsnextpitch@gmail.com within 30 days of account creation with subject "Arbitration Opt-Out."
If any part of this arbitration agreement is found invalid, the remainder stays in effect, except that the class action waiver is essential - if it's invalid, this entire arbitration section is void.
19. Indemnification
You agree to defend, indemnify, and hold harmless NextPitch Analytics, Inc., and our affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
Your violation of these Terms of Service
Your use or misuse of the service
Your violation of any rights of another party, including privacy or intellectual property rights
Your violation of any applicable laws or regulations
Any content you submit, post, or transmit through the service
Any athletic activities or training decisions made using our analytics
20. Severability and Entire Agreement
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect. These terms constitute the entire agreement between you and NextPitch Analytics, Inc. regarding the service.
21. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated through the app or via email with at least 30 days' notice.
Continued use of the service after changes take effect constitutes acceptance of the updated terms. If you do not agree to the changes, you must stop using the service and may delete your account.
The "Last updated" date at the top of this document indicates when these Terms were last revised.
